ELECTION OF CHAIR FOR THE MEETING

Minutes:

Councillor Cessfordproposed that Councillor Hutchinson be elected as Chair of the meeting, this was seconded by Councillor Gibson. 

 

RESOLVED that Councillor Ian Hutchinson be elected as Chair for the duration of the meeting.

(1)  Variation of Premises Licence in respect of Auction House, Bridge Street, Morpeth, NE61 1PQ

 

To determine an application for the variation of a premises licence from Mr Philip Steel on behalf of Hotels International Ltd in respect of Auction House, Bridge Street, Morpeth.

 

The applicant has applied to vary the licensable activities to increase the time for recorded music indoors from 9:00 – 0:00 and the addition of off-premises supply of alcohol in sealed containers.  One representation of support and three objections have been received from interested parties on the grounds of the prevention of public nuisance.

The Chair outlined the rules of the hearing and procedure to be followed at the meeting. 

 

Heather Gebbie, Senior Licensing Officer advised the reason for the hearing was to determine an application from Mr Philip Steel, the applicant, for a Premises Licence in respect of The Auction House, Bridge Street, Morpeth, NE61 1PQ. 

 

Within the application, the applicant had applied to vary the licensable activities to increase the time for recorded music indoors from 9:00 – 00:00 and the addition of off-premises supply of alcohol in sealed containers. 

 

The Committee read representations from the Planning Officer, Environmental Health Officer, four residents and Morpeth Town Council. 

 

Verbal representations were heard from Mr Steel, the Applicant. 

 

The Subcommittee considered the Licensing Act National Guidance and the Council’s own Licensing Policy. 

 

Following the hearing, members adjourned to a private session to determination the application. 

 

The Subcommittee determined to GRANT the variation to the premises licence in the following terms:- 

 

  • Provision of recorded music 09:00 hours – 00:00 hours Monday to Saturday 
  • Supply of alcohol off the premises 11:00 hours to 23:00 hours Monday to Sunday 

 

Additional conditions to be attached to the licence are:- 

 

  • Noise from amplified recorded music arising from the regulated entertainment held within the premises after 23:00 hours shall be inaudible at the boundary of the nearest residential dwellings 
  • All sales of alcohol for consumption off the premises shall be in a sealed container only 

 

 

 

Reasons:- 

 

  1. Save for the Planning Officer and Environmental Health (in respect of which an additional condition regarding noise had been agreed by the applicant), there were no representations from any of the Responsible Authorities.  Morpeth Town Council supported the application.  The Subcommittee considered the representations received in respect of the four residents. 

 

  1. The Subcommittee does not believe that any of the four licensing objectives will be prejudiced by the provision of recorded music from the premises or the supply of alcohol off the premises. 

 

  1. The Subcommittee is of the view that the imposition of the additional condition regarding noise from amplified music and the additional condition requiring all off sales of alcohol to be in sealed containers should mitigate any concerns from residents regarding potential nuisance from patrons of the premises. 

 

There is a right of appeal to the Magistrates’ Court against this decision which must be lodged within 21 days of the date of the written notification of the decision.
