Councillor Parry proposed that Councillor Hutchinson be elected as Chair of the meeting, this was seconded by Councillor Cessford.

RESOLVED that Councillor Ian Hutchinson be elected as Chair for the duration of the meeting.

1.     APPLICATION FOR A PREMISES LICENCE IN RESPET OF THE FLYING GANG BREWING, MEADOWFIELD INDUSTRIAL ESTATE, PONTELAND, NE20 9SD.

To determine an application from Mr Andrew Findlay for the application of a premises licence in respect of Flying Gang Brewing, Meadowfield Industrial Estate, Ponteland, NE20 9SD.

The applicant has applied for the licensable activities of the supply of alcohol on and off the premises on: -

•Friday15:00 –21:00

•Saturday and Sunday 12:00 – 21:00

Fourteen objections have been received from interested parties on the grounds of: -

•prevention of public nuisance

•protection of children from harm

•prevention of crime and disorder

•public safety

Application of a premises licence in respect of Flying Gan Brewing, Meadowfield Industrial Estate, Ponteland, NE20 9SD.

The Chair outlined the rules of the hearing and procedure to be followed at the meeting.

Tasmin Hardy, Licensing Manager, advised the reason for the hearing was to determine an application from Mr Andrew Findlay, the applicant, for a Premises Licence in respect of Flying Gang Brewing, Meadowfield Industrial Estate, Ponteland.

Within the application, the applicant had applied to for the premises licence to allow the supply of alcohol on and off the premises, Friday 15:00 to 21:00 and Saturday and Sunday 12:00 – 21:00.

Extra conditions to the licence had been agreed by the applicant and Northumbria Police.

Fourteen objections had been received from interested parties on the grounds of public nuisance, crime and disorder, public safety and the protection of children from harm.

The Subcommittee received the written report of the Licensing Officer and heard evidence from Mr Findlay, the Applicant, Mr Buckley, Co-Director.  Representations were heard from resident, Mr Nutt and Katrina Woodrow from Ponteland Town Council.

The Subcommittee considered the Licensing Act National Guidance and the Council’s own Licensing Policy.

Following the hearing, members adjourned to a private session to determination the application.

The Subcommittee determined to GRANT the variation to the premises licence in the following terms:-

Supply of alcohol on and off premises

Friday 15.00 to 21.00

Saturday – Saturday 12.00 – 21.00

The Conditions to be attached to the licence are:-

·       Mandatory conditions

·       The fourteen conditions as per applicant’s Operating Schedule.

Reasons:-

1.       The Sub Committee has taken into account that no representations have been made by any of the responsible authorities in respect of the application. 

2.       Whilst the Sub Committee has taken into account the representations made by residents and the Town Council, the Sub Committee believes there is no evidence that the licensing objectives of the prevention of crime and disorder, public safety, prevention of public nuisance and protection of children from harm will be prejudiced by the grant of the premises licence.

3.       The Sub Committee has taken into account the style of operation of the premises, noting it’s limited operating hours and the type of products sold from the premises and believe that that the conditions of the licence will ensure that the licensing objectives are protected. 

There is a right of appeal to the Magistrates’ Court against this decision which must be lodged within 21 days of the date of the written notification of the decision.
