ELECTION OF CHAIR FOR THE MEETING

Minutes:

Councillor Cessfordproposed that Councillor Hutchinson be elected as Chair of the meeting, this was seconded by Councillor Crosby. 

 

RESOLVED that Councillor Ian Hutchinson be elected as Chair for the duration of the meeting.

Variation of premises licence in respect of Queen’s Head, 7 High Street, Newbiggin by the Sea.

 

To determine an application for the variation of a premises licence from Ward Hadaway Solicitors on behalf of Springs Sanctuary Spa (Kingston Park) Ltd in respect of Queens Head, 7 High Street, Newbiggin by the Sea, NE64 6AT.

 

The applicant has applied to vary the licence to extend the area in within which the licensable activities can take place, to modernise the conditions attached to the licence and to add films, live music, late night refreshment as licensable activities and to make changes to the layout of the premises.

 

Six objections have been received from interested parties on the grounds of:-

 

• prevention of public nuisance

• prevention of crime and disorder

• public safety

The Chair outlined the rules of the hearing and procedure to be followed at the meeting. 

 

Heather Gebbie, Senior Licensing Officer advised the reason for the hearing was to determine an application from Ward Hadaway Solicitors on behalf of the applicant, Springs Sanctuary Spa, for a Premises Licence in respect of The Queen’s Head, 7 High Street, Newbiggin by the Sea, NE64 6AT. 

 

The applicant had applied for the licensable activities to extend the area within which the licensable activities could take place, to modernise conditions attached to the licence and to add films, live music, late night refreshment and licensable activities and to make change to the layout of the premises. 

 

Six objections had been received from interested parties on the grounds of:- 

 

  • Prevention of public nuisance 
  • Prevention of crime and disorder 
  • Public safety 

 

Verbal representations were heard from Richard Arnot, the applicant’s legal representative, and Stephen Burden and Kay Scott, interested parties. 

 

A written representation had been received from the Environmental Health Department advising of 3 agreed conditions with the applicant and 7 written representations from 9 residents. 

 

The Subcommittee considered all written and verbal representations and the Licensing Act National Guidance and the Council’s own Licensing Policy. 

 

Following the hearing, members adjourned to a private session to determination the application. 

 

The Subcommittee determined to GRANT the variation to the premises licence for:- 

 

Provision of films (indoors) 

Monday to Sunday 09:45 – 00:00 

The activity may be extended from finish time on New Year’s Eve to start on time on New Year’s Day 

 

Live music (indoors and outdoors) 

Monday to Sunday 09:45 – 00:00 

The activity may be extended from finish time on New Year’s Eve to start on time on New Year’s Day 

 

Late night refreshment (indoors and outdoors) 

Monday to Sunday 23:00 – 00:00 

This activity may be extended from finish time on New Year’s Eve to 05:00 on New Year’s Day 

 

The premises licence is varied to incorporate the new plan and layout submitted with the variation application. 

 

The conditions to be attached to the licence are varied:- 

 

  • Removal of conditions 1-6 of Annex 2 

 

Additional conditions to be added:- 

 

  • The number of table and chairs shown on the deposited plan shall not be reduced 
  • The premises Licence Holder shall ensure that when regulated entertainment is taking place all windows, and the lobby doors shall be kept shut except for access and egress 
  • A CCTV system shall be installed and maintained in proper working order at the premises.  Such systems shall:- 
  1. be operated by properly trained staff 
  1. be in operation at all times the premises are open to the public 
  1. ensure coverage of all public entrances and exits to the premises 
  1. ensure coverage of all areas to which the public have access except toilet facilities
