RESOLVED that the minutes of the meeting of North Northumberland Area Council (Rights of Way) Subcommittee held on 8 July 2021, as circulated, be confirmed as a true record and be signed by the Chair.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY. ALLEGED BYWAYS OPEN TO ALL TRAFFIC Nos 35 & 22 PARISHED OF HARBOTTLE & NETHERTON pdf icon PDF 4 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U4029 road, from the C179 road, west of Burradon Hall, in a general south-westerly direction to the U4019 road, north of Sharperton Edge.

 

Minutes:

D. Brookes - Infrastructure Records Manager, introduced the above report in which members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U4029 road, from the C179 road, west of Burradon Hall, in a general south-westerly direction to the U4019 road, north of Sharperton Edge.         

 

Councillor Hardy proposed to accept the officer’s recommendation, which was seconded by Councillor Swinbank. Upon being put to the vote, the motion was unanimously agreed, and it was;

 

RESOLVED that:

·       There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route K-J-H

·       The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public’s motorized vehicular rights over the K-J-H route

·       The route to be included in a future Definitive Map Modification Order as a byway open to all traffic

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over part of the U4025 road, from the C179 road, north-east of Plainfield, in a general westerly then south-westerly direction, to the C172 road, south-west of Plainfield.

Brookes - Infrastructure Records Manager, introduced the above report in which members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over part of the U4025 road, from the C179 road, north-east of Plainfield, in a general westerly then south-westerly direction, to the C172 road, south-west of Plainfield.

 

Councillor Seymour proposed to accept the recommendation from the Officer, which was seconded by Councillor Hardy. Upon being put to the vote, it was unanimously agreed, and it was;

 

RESOLVED that:

·       There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route S-Q-P

·       The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public’s motorized vehicular rights over the S-Q-P route

·       The route be included in a future Definitive Map Modification Order as a byway open to all traffic.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY. ALLEGED BYWAY OPEN TO ALL TRAFFIC No 38 PARISH OF HEPPLE pdf icon PDF 4 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U4057 road, from the B6341 road, at Hepple, in a general north-westerly and northerly direction, to Restricted Byway No 6, south-east of Wreighill.

 

Minutes:

D. Brookes - Infrastructure Records Manager, introduced the above report in which members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U4057 road, from the B6341 road, at Hepple, in a general north-westerly and northerly direction, to Restricted Byway No 6, south-east of Wreighill.

 

Councillor Hardy proposed to accept the Officer’s recommendation, this was seconded by Councillor Renner-Thompson. Upon being put to a vote, it was unanimously agreed, and it was;

 

RESOLVED that:

 

·       There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route V-W

·       The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public’s motorized vehicular rights over the V-W route

·       The route be included in future Definitive Map Modification order as a byway open to all traffic.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY. ALLEGED RESTRICTED BYWAY / PUBLIC FOOTPATH No 13 PARISH OF SNITTER pdf icon PDF 3 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the C172 road, south-west of Flotterton Cottages, in a general north-westerly direction, to the U4025 road (alleged Byway Open to All Traffic No 12) at Plainfield.

 

Minutes:

D. Brookes - Infrastructure Records Manager, introduced the above report in which members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over a route from the C172 road, south-west of Flotterton Cottages, in a general north-westerly direction, to the U4025 road (alleged Byway Open to All Traffic No 12) at Plainfield.

 

Councillor Hardy proposed to accept the recommendation of the Officer, this was seconded by Councillor Swinbank. Upon being put to the vote, it was unanimously agreed, it was;

 

RESOLVED that:

 

·       There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route R-T-U

·       The Natural Environment and Rural Communities Act 2006 would appear to have extinguished the public’s motorized vehicular rights over the R-T-U route.

·       The route be included in a future Definitive Map Modification Order as a restricted byway.
