MEMBERSHIP AND TERMS OF REFERENCE

The committee is asked to note the following membership and terms of reference for the North Northumberland Local Area Council (Rights of Way) Subcommittee as agreed at the meeting of the North Northumberland Local Area Council on Thursday 24 June 2021.?

Terms of reference:

To exercise functions in relation to the survey, definition, maintenance, diversion, stopping up and creation of public rights of way in the north Northumberland area, on behalf of the North Northumberland Local Area Council.? 

 

Minutes:

The membership and Terms of Reference agreed by the North Northumberland Local Area Council on 22June 2021 was circulated for information.

 

The chair explained that the Independent Group had gifted their place to the other groups.

 

RESOLVED that the information be noted.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY ALLEGED BYWAY OPEN TO ALL TRAFFIC No 31 PARISH OF EDLINGHAM pdf icon PDF 7 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U3058 road, from the A697 road, south west of High Learchild, in general north-easterly and northerly direction, to the C90 road, east of Jockyside Bridge

Minutes:

The Definitive Map Officer introduced the above report in which members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U3058 road, from the A697 road, south west of High Learchild, in general north-easterly and northerly direction, to the C90 road, east of Jockyside Bridge.

 

Background information was provided, and Members were advised that consultation had been carried out as set out on page 7 of the report with support from Cycling UK and the British Horse Society received.  Edlingham Parish Council had strongly objected to any downgrading of the U3058 road and other U roads in the local area.

 

          Councillor Renner-Thompson moved to support the recommendation set out in the report, this was seconded by Councillor Seymour. Upon being put to the vote, the motion was unanimously agreed, and it was:

 

          RESOLVED that:

 

(i)             There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route J-K-L

(ii)            The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public’s motorised vehicular rights over the J-K-L route.

(iii)          The route be included in a future Definitive Map Modification Order as a byway open to all traffic.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY ALLEGED BYWAY OPEN TO ALL TRAFFIC No 32 PARISH OF EDLINGHAM pdf icon PDF 6 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over part of the U3059 road, from the U3058 road, north-east of High Learchild, in an easterly direction, to the C89 road, at Hill Head.

The Definitive Map Officer introduced the above report in which Members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over part of the U3059 road, from the U3058 road, north-east of High Learchild, in an easterly direction, to the C89 road, at Hill Head. 

 

          Background information was provided, and Members were advised that consultation had been carried out as outlined on page 71 of the report with support from Cycling UK and British Horse Society received.   Edlingham Parish Council had strongly objected to any downgrading of the U3059 road and other U roads in the local area.

 

          Councillor Seymour moved to support the recommendation set out in the report, this was seconded by Councillor Renner-Thompson. Upon being put to the vote, the motion was unanimously agreed, and it was:

 

          RESOLVED that:

 

(i)             There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route K-M.

(ii)            The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public’s motorised vehicular rights over the K-M route.

(iii)          The route to be included in a future Definitive Map Modification Order as a byway open to all traffic.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY ALLEGED BYWAY OPEN TO ALL TRAFFIC No 32 PARISH OF NEWTON-ON-THE-MOOR pdf icon PDF 5 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U3096 road, from the C106 Alnwicks Fords road, north of the Overgrass, in a north-westerly direction to Glantless Farm.

          The Definitive Map Officer introduced the above report in which Members were asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public vehicular rights over the U3096 road, from the C106 Alnwick Fords road, north of the Overgrass, in a north-westerly direction to Glantlees Farm.

 

          Background information was provided, and Members were advised that consultation had been carried out as set out on page 125 of the report with support from Cycling UK and the British Horse Society.

 

          Councillor Hardy moved to support the recommendation set out in the report, this was seconded by Councillor Seymour. Upon being put to the vote, the motion was unanimously agreed, and it was

 

          RESOLVED that:

 

(i)             There is sufficient evidence to indicate that public vehicular rights have been reasonably alleged to exist over the route M-N.

(ii)            There is sufficient evidence to indicate that public vehicular rights have been shown to exist, on a balance of probabilities, over the route N-P-Q.

(iii)          The Natural Environment and Rural Communities Act 2006 would not appear to have extinguished the public motorised vehicular rights over the M-N-P-Q route.

(iv)          The route be included in a future Definitive Map Modification Order as a byway open to all traffic.

REVIEW OF THE DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY ALLEGED PUBLIC BRIDLEWAY No 5 PARISH OF LONGFRAMLINGTON pdf icon PDF 5 MB

The North Northumberland Local Area Council Rights of Way Sub-Committee is asked to consider all the relevant evidence gathered in support and in rebuttal of the existence of public bridleway rights over existing Public Footpath No 5 in the Parish of Longframlington, from Bridleway No 1 in the Parish of Newton-on-the-Moor, north-east of Snook Bank, to Bridleway No 25 in the Parish of Edlingham, north-west of Snook Bank.

The Definitive Map Officer introduced the above report in which Members were asked to consider all the relevant evidence gathered in support and rebuttal of the existence of public bridleway rights over the existing Public  Footpath No 5 in the Parish of Longframlington, from Bridleway No 1 in the Parish of Newton-on-the-Moor, north-east of Snook Bank, to Bridleway No 25 in the Parish of Edlingham, north-west of Snook Bank.

 

          Background information was provided, and Members were advised that consultation had been carried out as set out on page 176 of the report with support from Cycling UK and the British Horse Society.

 

          Councillor Renner-Thompson moved to support the recommendation set out in the report, this was seconded by Councillor Hardy. Upon being put to the vote, the motion was unanimously agreed, and it was

 

          RESOLVED that:

 

(i)             There is sufficient evidence to indicate that public bridleway rights have been shown to exist, on a balance of probabilities, over the route H-G.

(ii)            The route be included in a future Definitive Map Modification Order to upgrade the footpath to public bridleway status.
